Waiver & Participation Agreement
Summary
By booking or participating in any activity at Earth Arts Pottery Studio (“EAPS”), you agree to the following:
- Ceramic activities involve inherent risks, and you participate at your own discretion.
- A parent or legal guardian must authorize participation for any minor.
- Cancellation and rescheduling policies vary by offering and are outlined below.
- Finished Paint Your Own Pottery (PYOP) pieces are non-refundable.
- Event deposits are non-refundable but may be applied to a rescheduled event within the allowed window.
- Finished work must be picked up within 30 days of notification.
- EAPS may photograph activities for promotional use unless you opt out.
- Participation is governed by New York State law.

EAPS Waiver & Participation Agreement
This waiver applies to all EAPS activities, including open studio reservations, workshops, courses, camps, events, and parties. By participating, you agree to the following terms.
1. Authority to Book & Guardianship
By making a booking with Earth Arts Pottery Studio (“EAPS”), you represent that you have the legal authority to enter into this agreement for yourself and for all participants included in your booking.
If any participant is under the age of 18, the booking must be made by a parent or legal guardian, or with the express permission of a parent or legal guardian. By completing a booking that includes a minor, you confirm that you are authorized to consent on their behalf and agree to all terms of this waiver for that minor.
Certain offerings may include additional age requirements or restrictions. Events involving alcohol (BYOB) are strictly limited to participants 21 years of age or older. Valid identification may be required.
2. Assumption of Risks
Participation in pottery and art activities—including wheel throwing, hand-building, glazing, firing, paint-your-own-pottery (PYOP), camps, classes, parties, and off-site events—involves inherent risks. These may include, but are not limited to, slippery floors, sharp tools, heavy objects, chemical glazes, kiln heat, physical exertion, and accidental contact with others.
By participating, you voluntarily assume all risks of injury, illness, property damage, or loss for yourself and for any participant included in your booking.
3. Safety Protocols
To maintain a safe studio environment:
- Only EAPS staff and authorized instructors are permitted in the kiln room or to operate kilns and related equipment.
- Participants must follow all staff instructions regarding tools, materials, and studio conduct.
- Security cameras are used in common areas of the studio for the safety of guests, staff, and property.
- EAPS reserves the right to remove any participant who fails to follow safety guidelines, without refund.
Please inform staff of any medical conditions, allergies, or accessibility needs prior to participation.
4. Cancellation & Rescheduling Policy
Classes, Workshops, Camps, and Programs
Cancellations are permitted up to 7 days before the start date.
Cancellations made within this window will receive a studio credit equal to 50% of the booking value. Credits are issued within 7 days and may be used toward a future class, workshop, or Open Studio visit.
Rescheduling is permitted up to 7 days before the start date. If no alternate dates are available, the request will be treated as a cancellation under this policy.
Cancellations or rescheduling requests made less than 7 days before the start date are not eligible for a refund or credit.
Private Parties & Events
You may reschedule your event up to 14 days before the scheduled date at no additional cost, subject to availability.
Event deposits are non-refundable. Because private events reserve dedicated studio time and staffing, deposits cannot be refunded or transferred once you are within the 14-day rescheduling window. If rescheduled within the permitted window, the deposit will be applied to the new date.
Memberships (EAPS Circle)
Membership cancellations and terms are governed by the separate EAPS Circle membership agreement.
5. Returns & Refunds
Paint Your Own Pottery (PYOP)
All PYOP pieces are custom-made. Refunds are not offered on finished PYOP items. In the unlikely event that a finished piece is damaged or defective due to an error by EAPS, a studio credit will be issued to remake the same piece.
Paint Your Own Pottery (PYOP)
Unused and unopened retail items may be returned within 14 days of purchase. Items must be in original condition.
Items over $100 will be refunded to the original form of payment, less any applicable processing fees.
Items under $100 may be refunded in full or issued as studio credit.
6. Finished Work & Pick-Up
EAPS handles all glazing and firing of work created in the studio. Variations and occasional firing defects are a natural part of ceramics. EAPS is not responsible for loss or damage occurring during the firing process.
Guests will be notified when finished work is ready for pickup. Notification may be provided via email, text message, phone call, or verbal guidance at the time of participation. In most cases, pieces are ready approximately one week after completion, though timing may vary.
Finished work must be picked up within 30 days of notification. Due to limited storage space, unclaimed items may be donated or discarded after this period.
7. Media Release
By participating in EAPS activities, you grant EAPS permission to photograph, video, or otherwise record you and your work for promotional purposes, including use on websites, social media, and marketing materials.
You may opt out of media usage for a single event or for all future events by emailing hello@earthartslb.com at least 48 hours before your scheduled session. Please specify whether your opt-out applies to one session or all future participation
8. Youth Programs & Minors
Parents and legal guardians are responsible for the conduct and supervision of minors participating in EAPS activities. By enrolling a minor, you assume full responsibility for that participant.
Emergency contact information, authorized pickup persons, and relevant medical or allergy information must be provided at registration. Children will only be released to authorized individuals.
9. Health Guidelines
Participants agree to follow all health and safety guidelines in place at the time of their visit. These may include measures related to sanitation, illness prevention, or public health guidance.
If you or any participant is feeling unwell or has been exposed to a contagious illness, please contact EAPS to discuss rescheduling options.
10. Governing Law & Agreement
This waiver and all services provided by EAPS are governed by the laws of the State of New York. Any disputes shall be resolved in the courts of Nassau County, New York, or through mediation at EAPS’s discretion.
Parents or legal guardians signing on behalf of a minor release EAPS from liability for injuries or damages except where caused by gross negligence or willful misconduct.
By completing a booking or participating in any EAPS activity, you acknowledge that you have read, understood, and agreed to this waiver for yourself and for any participant you represent.
